    Terms and Conditions - Policies for U.S. customers:


    Acceptance: By making a purchase, providing your information for processing your order and/or receiving shipment of merchandise, you are agreeing to our store policies and entering into a legally binding contract with Atlas Pro Audio under the terms set forth in writing located on this page of our website. Please take the time to read this page completely. Thank you.
    Billing Address vs. Shipping Address: It is the credit cards' rule that merchants ship only to a customer's billing address. Some credit cards will allow a customer to authorize a secondary shipping address to their account, this can only be verified by phone with the issuing bank. We will, upon request, ship to your authorized secondary shipping address if it is verifiable with the issuing bank of the credit card. If you have not intentionally set up your secondary address it will not be on your account, and therefore not verifiable until it is set up. We know some stores haphazardly send products to any address, but this is a gross disservice to the customer and themselves, and allows and encourages credit card fraud.

    Sales Tax: FL state residents will be charged sales tax, based on FL county. If you are tax exempt in FL, we will need a Fax/Photocopy of Tax ID Number sent to us before payment is made.

    Our Satifaction Gaurantee Exchange Policy:
    In the event that you have purchased a piece of gear that you do not like, you can send it back to us within 14 days for full store credit, minus the original shipping cost (free shipping must be reinbursed). Store credit can only be used as store credit, cash will not be given (see return policy). Your store credit can be used to purchase another item which would suit your needs. Due to the abuse of this policy, we reserve the right to deny any exchange or return at our sole discretion, this will apply mainly to items that are missing (i.e. cables, manual, etc.) damaged when in the possession of the customer or non-returnable items. If item is returned damaged, it is the discretion of Atlas Pro Audio to refuse the item, or to assess the actual damage fee to be deducted in addition to the rental/return fee deduction. Please inspect all merchandise immediately upon reciept and let us know if there is any cosmetic or electronic damage. As the original shipper, we will need to make a claim of damage to UPS, Fed Ex, or Postal on your behalf. If we aren't notified of damage immediately, the parcel service used will not allow a claim.


    Store Credit Policy:
    To prevent some customers from continually buying and returning items for store credit, we have had to limit our policy so that items purchased with full or partial store credit are not able to be returned or exchanged. Also See Above.


    Return Policy:
    We hope that all your gear choices with us are satifying ones. In the rare event that you want to return an item for a refund, it must be done so within 7 days. In order to the depreciation of that demo/return unit returning to us, all returned items are subject to 15% restock (rental) fee and shipping costs incurred.

    Due to the misuses and abuses of some individuals, we must enforce the return policy, in order to prevent some unscrupulous buyers from obtaining gear under the pretense of a purchase in order for them to use it as a "free rental" for their recording session.

    We are unable to accept any returns after 7 days after purchase date. Shipping and handling charges are not refundable. If you received free or discounted shipping and handling, you will be required to reinburse us for the shipping and handling you received.

    Cancellation Policy:
    We can not cancel any orders once a credit card has been charged. All returned items are subject to 15% restock fee and shipping and handling costs. Special ordered items are NON-RETURNABLE, NON-CANCELABLE.

    Shipping and handling charges are not refundable. If you received free shipping and handling, or promotional shipping and handling, you will be required to reinburse us for the shipping and handling you received in addition to the extra shipping and handling from receipient back to us.


    Authorized vs. Unauthorized Returns: Unauthorized returns will not be accepted. To return or exchange and item you will need a valid RA number, issued by us. There are fees associated with returning an item. You will be responsible for restock fees, plus the shipping accrued, even if shipping is not invoiced on your receipt. If you received promotional shipping/ free shipping on an item you will be required to reinburse us for the shipping we had paid on that item to you.

    Non-Returnable & Non-Exchangeable Items:
    Please note that there are certain items that can not be returned. There is a strict no return/no refund/no exchange policy on all special orders, all personal items like headphones, cables, used, demo, or consignment gear. Damaged or abused gear can not be returned. Items purchased with store credit can not be returned or exchanged. All non-new gear is thoroughly inspected to be in top working order before shipping. All customer who purchase used/demo/consignment gear are required to check the gear immediately upon arrival to make sure the gear is in top working order. In the event that your gear arrives damaged, a shipping damage claim should be made within 24 hours of receipt of the package with the shipping company.


    Bundle Pricing:
    If you receive a bundle price on a group of items, and you return one or more items, your discount will be nullified, and the stated internet pricing (found online at www.atlasproaudio.com) will be used to determine the final invoice price of the merchandise purchased.
    Shipping Methods: We ship with UPS primarily. You may choose the method of your shipment depending on how fast you would like it to you. WE DO NOT SHIP VIA USPS (United States Postal Service) unless is is international, some restrictions apply (if you are outside the US please see International Customer section).

    Shipping Time:

    EXPRESS Shipping:
    We can not guarantee delivery times. We will not cancel orders due to the mistake of any carrier or due to a mistake on the part of the buyer in choosing a slower method of shipping in light of a deadline the buyer may have. We can only control when an item is sent, and the method which it was sent, we make no gaurantees to delivery time. If we send an item Overnight with Saturday delivery out on Friday and it does not arrive, it is the fault of the carrier, we will not cancel the order or accept a return on this shipment without an RA number (See return policy below). If the carrier does not deliver on the time guaranteed, you will be entitled to a refund of the shipping cost. There are occasions when we may send items overnight (by 10am, 12pm, or 3pm), 2 Day, 3 Day, and the carrier (i.e. UPS or FedEx) does not fulfill their obligations on delivery time.

    GROUND Shipping:
    We will not cancel orders due to the mistake of any carrier (i.e. UPS, Fed Ex, or USPS) or due to a mistake on the part of the buyer in choosing a slower method of shipping in light of a deadline the buyer may have. We can only control when an item is sent, and the method which it was sent, we make no gaurantees to delivery time due to the fault of the carrier company.

    Shopping Cart:

    We have a Paypal shopping cart which allows you to choose from using your credit card or checking account to send echecks. If you use the shopping cart on the Paypal system, you MUST HAVE A CONFIRMED ADDRESS, NON CONFIRMED ADDRESSES WILL NOT BE PROCESSED since they are not convered under the Paypal merchant protection policy. We also do not accept International payment via Paypal. To make using the shopping cart more simple, we are adding the cost of US Ground shipping (with insurance) to the item, when you "Checkout" it will simply add your item total. If you need faster shipping, please call directly to place your order with us by phone or fax. That is the best way to make sure you will receive what you need if you have a deadline.     Pricing Errors:

    Errors in pricing will not be honored. Occasionally there may be mistakes on our website, if you have seen an error, or think you have seen an error, please point it out to us.


    Damage or Warranty Repair Policy:

    All customer are required to check the gear immediately upon arrival to make sure the gear is in top working order. Atlas Pro Audio is not responsible for damaged gear. In the event that your purchase is defective or D.O.A. (not as a result of shipping), a claim must be made with the manufacturer. Contact us immediately and we will help you get a replacement item as soon as possible.

    In the event that your gear arrives damaged through shipment (i.e. UPS, FedEx, USPS, etc.), a shipping damage claim must be made within 24 hours of receipt of the package with the shipping company. Please report any damages to us immediately, and we will help you get a replacement product as soon as possible.

    If you need to return a piece for repair, please let us know, we can help you get an RA number from the factory.

    Customers are responsible to pay for shipping to the factory on warranty/repair items. The factory covers the shipping back to the customer. If an item is DOA (dead on arrival), the manufacturer may cover the shipping to the factory, contact the factory for more information. If a customer sends an item in for repair and it is not broken, the factory may charge bench time and return shipping costs.

    International Customers Please Read:

    We do ship internationally for some of the brands we carry. Please email us to see if the items you want are able to be sold outside the US. There are NO RETURNS, NO REFUNDS on international orders. We accept Bank Wire transfer for international orders. We are able to accept Paypal from Canada if your account is confirmed. Please note: We do not accept international credit cards or International Paypal Payments with the exception of confirmed payments from Canada. We will not alter customs forms. The actual cost of the items will be marked on all customs forms and receipts. Customer is responsible for all customs duties and shipping costs. In the event your equipment is damaged in shipping a claim must be made with the carrier. We do not provide advanced replacements on damaged gear. Customer is responsible for all to and from shipping for warranty repair.

    International Shipping:

    We prefer to use UPS for international shipments. We will use USPS when items are able to be sent fully insured, some countries limit the insurance values to lower amounts. We will not alter customs forms. The actual cost of the items will be marked on all customs forms and receipts. Customer is responsible for all customs duties and shipping costs. In the event your equipment is damaged in shipping a claim must be made with the carrier. We do not provide advanced replacements on damaged gear. Customer is responsible for all to and from shipping for warranty repair.

    Refusal of Goods:
    Any purchase that is refused upon delivery is subject to a 15% restock fee. EVEN IF IT IS NOT OPENED. In the past we have had individuals try to refuse items. We expect our customers to be honorable in their intention to buy an item, if you do not want it, please do not order it. By providing your name and information and making a purchase, you are accepting the terms that are posted here. This is a legally binding agreement (see acceptance clause below).

    You are also responsible to pay the cost of shipping and handling added to 15%. This amount will be taken from the purchase price, and the remainder will be refunded. You will be required to sign an acceptance letter itemizing the restock fee, shipping/handling fee and the refund amount. You will need to provide proof of identity with a valid Driver's license. If this is contested, we will pursue all legal means of obtaining these fees.
    Refusal to Pay fees incurred on an order:
    We reserve the right to collect on any outstanding debt incurred by a customer associated with the purchase and or return of goods. We will use all avenues to collect this debt, and this can include a collection agency and/or court order. Legal:
    Atlas Pro Audio reserves the right to claim for all fees (product, damages, rental fees, usage fees, shipping/handling charges, time, attorney fees, court and legal fees) related to all legal claims made against or for Atlas Pro Audio, Inc.

    In the event that legal proceedings are required to resolve disputes, all legal proceedings will be filed in Hillsborough County Florida and take place in Hillsborough County, FL.

    Atlas Pro Audio reserves the right to to change our prices, policies, our website, and deny any sale or service at our sole discretion. The policies posted here supercede all other written, verbal, or implied conditions.
